Terms of Service
These Terms of Service apply to all website design, development, consulting and support services provided by Cloud Web Design, a brand of Pistol Group.
By requesting a quote, accepting a proposal, making payment, or using our services, you agree to these terms.
1. Services
Cloud Web Design provides website design and development services for Australian businesses.
Our services may include website design, website development, WordPress websites, Shopify websites, Squarespace websites, website redesigns, landing pages, website updates, SEO setup, website consulting and ongoing support.
The exact services included in your project will be listed in your quote, proposal, invoice, or written agreement.
2. Quotes And Scope
All quotes are based on the information provided at the time of quoting.
If the project changes after the quote is approved, extra costs may apply. This includes extra pages, new features, design changes, additional revisions, new integrations, custom functionality, or changes to the original direction of the project.
We will let you know if a request is outside the original scope before completing the additional work.
3. Payments
Payment terms will be shown on your invoice or proposal.
A deposit may be required before work begins. Final payment may be required before the website is launched, transferred, or handed over.
Late payments may delay the project. We may pause work until overdue payments are received.
All prices are in Australian dollars unless stated otherwise.
4. Client Responsibilities
You agree to provide the information, content, feedback and approvals needed to complete the project.
This may include business details, website text, images, logos, product information, login access, brand guidelines and written feedback.
Delays in providing content, access, feedback, or approvals may delay the project timeline.
5. Website Content
You are responsible for making sure any content you provide is accurate, legal and suitable for use on your website.
This includes text, images, videos, logos, fonts, trademarks, product information and business claims.
We may help write, edit, or structure website content, but you are responsible for reviewing and approving the final content before launch.
6. Revisions
Your project may include a set number of revision rounds, depending on your quote or proposal.
A revision means a reasonable change to work already completed. It does not include a full redesign, a new page structure, new functionality, or a major change in direction after approval.
Extra revisions may be charged separately.
7. Project Timelines
We will do our best to complete your project within the estimated timeframe.
Project timelines may change due to late feedback, missing content, technical issues, third party delays, changes to the project scope, delayed payments, or extra requested work.
Any timeline provided is an estimate unless confirmed in writing.
8. Website Approval And Launch
Before launch, you are responsible for reviewing and approving the website.
Once approved, we may launch the website or provide instructions for launch.
After launch, we are not responsible for errors that were visible during the review stage and approved by you, unless we agree to fix them as part of post-launch support.
9. Hosting, Domains And Third Party Platforms
Cloud Web Design may work with third party platforms and services such as WordPress, Shopify, Squarespace, hosting providers, domain registrars, plugins, apps, payment gateways, email platforms and analytics tools.
We are not responsible for outages, errors, price changes, policy changes, platform limitations, security issues, or service interruptions caused by third party providers.
You are responsible for maintaining your own hosting, domain names, platform subscriptions, plugin licences, app fees and other third party costs unless agreed otherwise in writing.
10. SEO And Search Rankings
We may provide SEO friendly website structure, page titles, meta descriptions, image alt text, basic technical SEO setup and content guidance.
We do not guarantee any specific Google ranking, search engine position, traffic level, lead volume, sales result, or business outcome.
Search rankings depend on many factors outside our control, including competition, website history, backlinks, content quality, search engine updates and ongoing SEO work.
11. Website Performance
We aim to build websites that are professional, easy to use and suitable for your business needs.
Website speed and performance can be affected by hosting, images, plugins, apps, scripts, tracking codes, third party tools and platform limitations.
We are not responsible for performance issues caused by third party tools, hosting limitations, client changes, or items added after launch.
12. Intellectual Property
You keep ownership of the content, logos, images and materials you provide to us.
Once the project has been paid in full, you will own the final website design and content created specifically for your business, unless agreed otherwise in writing.
Cloud Web Design may retain ownership of reusable code, templates, tools, frameworks, processes, methods and concepts used to deliver the project.
You must not resell, copy, or reuse our work for another business or project without written permission.
13. Portfolio Use
Unless you request otherwise in writing, you allow Cloud Web Design to display your completed project in our portfolio, case studies, social media, marketing material and website.
This may include your business name, website screenshots, project summary and live website link.
14. Cancellations
You may cancel a project by giving written notice.
If a project is cancelled after work has started, you may be charged for work completed up to the cancellation date.
Deposits and progress payments are generally not refundable once work has started.
15. Refunds
Refunds are not provided for completed work, approved work, launched websites, consulting time, strategy work, design work, development work, third party costs, or change of mind.
If there is an issue with our work, please contact us so we can review it and offer a reasonable solution.
16. Support And Maintenance
Website support after launch is only included if stated in your quote, proposal, invoice, or support plan.
Ongoing support may include minor updates, plugin updates, troubleshooting, website changes, backups, security checks, or technical assistance.
Support does not include major redesigns, new features, custom development, or work outside the agreed support scope.
17. Client Changes After Launch
If you make changes to the website after launch, we are not responsible for errors, broken layouts, lost content, plugin conflicts, design issues, or technical problems caused by those changes.
We can assist with fixing these issues, but additional charges may apply.
18. Limitation Of Liability
To the maximum extent allowed by law, Cloud Web Design is not liable for loss of income, loss of sales, loss of profits, data loss, business interruption, search ranking drops, security breaches, platform outages, or indirect losses connected to the use of our services or your website.
Our total liability is limited to the amount paid by you for the specific service that caused the issue.
19. Privacy
We may collect basic personal and business information to provide our services.
This may include your name, business name, email address, phone number, website login details, project information and billing details.
We use this information to provide services, communicate with you, manage your project, issue invoices and improve our business operations.
20. Governing Law
These terms are governed by the laws of New South Wales, Australia.
Any disputes will be handled in accordance with the laws of New South Wales.
